Is Online Poker Legal in the United States?

We cannot answer that as we are not lawyers. After the passing of the UIGEA it made it illegal for banks and poker sites to process deposits and withdraws from United States residents. If you are starting out playing online poker acquire some information first by reading articles and posts and then start out playing at small stakes levels.

We are in process of building a poker strategy section here to our website with this being the first article. Before you even sit down at a real money table read some strategy articles on poker either in print or online. There is a great wealth of free information available to new poker players and it can be invaluable. There are also several great books written by poker pros like Phil Gordon, Doyle Brunson and Annie Duke to just name a few. Make an investment in yourself and take the time to read some pages and learn from the best in poker.

When you are ready to start out playing online, many think that free games are the best way to go (or people have been playing free games and winning and think they are ready for real money games) but avoid these tables at all costs.  When you are ready to play poker skip the free tables because the play is entirely different. People play differently when they have real money on the line. Think about it, playing at free tables there is no repercussions for chasing an inside straight or bluffing and going all in. If you lose your stack you simply reload your free chips and keep on playing. Make the same mistakes for real money and you will go broke quick!

Many Americans believe that playing online poker from the United States is illegal but this is just not true. As far as we know playing online poker from the US is not an illegal act. We are not lawyers and do not have any legal background but everything we have researched suggests that playing online poker from the USA is completely legal.

Many believe the Unlawful Gambling Enforcement Act (UIGEA) of 2026 made online poker illegal in the United States. If you actually read the bill (which you can here) nowhere does it say playing poker is illegal. What it does say is that banks cannot knowingly process cash transactions that are gambling related. The onus is on the banks and they would be the one breaking the law, not the player himself. So you may ask how do some USA poker sites still get deposits approved?

The main way they do this is by using a processor located outside the United States. The processors take the stance that because they are not located in the United States US laws do not apply to them. This way the banks who process the transaction here in the States have no idea it is gaming related. Some poker sites do a better job finding a good processor than others, and the USA online poker sites listed here all do a great job.
